Welcome to Strength Well (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile app, and related services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Service.

1. Acceptance of Terms

By using Strength Well, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (which is incorporated herein by reference). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of the Service

Strength Well is a fitness tracking app that allows users to record workouts, track progress, and manage personal fitness data. We also process payments for subscriptions and in-app purchases through third-party services such as RevenueCat, Apple’s App Store, and Google Play.

3. Eligibility

Our Service is intended for users who are at least 13 years old. If you are under 13, please do not use our Service. By using the Service, you represent and warrant that you are 13 years of age or older.

4. Account Registration

  • Account Creation: To access certain features of the Service, you may need to create an account. You agree to provide accurate and complete information when registering and to keep your account information updated.
  • Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you suspect any unauthorized use of your account.

5. Payment and Subscriptions

  • Payment Processing: Payments for subscriptions or in-app purchases are processed through third-party providers such as RevenueCat, Apple’s App Store, or Google Play. By making a purchase, you agree to the respective terms and privacy practices of these providers.
  • Billing: Subscription fees will be charged to your designated payment method according to the plan you select. All payments are non-refundable except as required by applicable law or as provided by the payment provider.
  • Subscription Cancellation: You may be offered a free trial period when you first subscribe to Strength Well. To avoid being charged, you must cancel your subscription before the end of the trial period through the platform where you subscribed (e.g., Apple App Store or Google Play Store). If you do not cancel before the trial ends, you will be automatically charged for the selected subscription plan. For ongoing subscriptions, you must cancel before your next billing cycle to avoid being charged for the next period. Cancellations take effect at the end of your current subscription term. No refunds will be issued for partial billing periods unless required by applicable law or permitted by your platform provider.
  • Important Notice: Deleting or uninstalling the Strength Well app from your device does not automatically cancel your subscription or delete your account. To cancel your subscription, you must follow the cancellation process provided by your platform (Apple App Store for iOS or Google Play Store for Android) or through your account settings. Please refer to the respective store’s policies for managing subscriptions.

6. User Conduct

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Service. Prohibited conduct includes, but is not limited to:

  • Uploading or transmitting any content that is illegal, harmful, or otherwise objectionable.
  • Interfering with or disrupting the Service or the servers/networks connected to the Service.
  • Using the Service for any unauthorized or fraudulent activities.

7. Intellectual Property Rights

  • Our Content: All content provided by Strength Well, including text, graphics, logos, images, and software, is the property of Strength Well or its licensors and is protected by applicable intellectual property laws.
  • User Content: By submitting any content (e.g., workout logs, feedback) to the Service, you grant Strength Well a worldwide, non-exclusive, royalty-free license to use, modify, reproduce, and display such content for the purposes of operating and improving the Service.
  • Restrictions: You may not use, modify, distribute, or reproduce any of our intellectual property without our express written permission.

8. Medical Disclaimer

The information provided by Strength Well is for informational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment. You should consult your physician or another qualified healthcare provider before starting any new fitness program, making any changes to your diet or exercise regimen, or if you have or suspect you may have a health problem. By using the Service, you acknowledge and agree that Strength Well is not responsible or liable for any injury, loss, or damage incurred as a result of your reliance on any information provided through the Service. Use of the Service is at your own risk.

9. Disclaimers

  • No Warranty: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Strength Well disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Limitation of Advice: The Service is designed to help users track their workouts and progress and is not intended to provide comprehensive fitness or health advice.

10. Limitation of Liability

To the fullest extent permitted by law, Strength Well, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of, or inability to access or use, the Service;
  • Any unauthorized access to or use of our servers and/or any personal information stored therein; or
  • Any other matter relating to the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless Strength Well, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.

12. Modifications to the Service and Terms

  • Service Changes: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice.
  • Terms Updates: We may update these Terms from time to time. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in England and Wales.

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service or to Strength Well.

15. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Strength Well regarding the use of the Service.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: The failure of Strength Well to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
